Subject to any statutory term to the contrary, Marketing for Business Success
Pty Ltd in no event shall be liable for any indirect, consequential or special
damages whatsoever resulting from the loss of data, profits or use, whether in
action of negligence, contract or any other action resulting out of or in
connection with the use of the M4B Marketing Software (“software”),
documentation or information provided on this website.
The M4B Marketing Software is software specifically designed for marketing
applications for businesses and as such is not of a kind ordinarily used for
personal, household use or consumption. Accordingly as part of the licence
terms the licence holder agrees that in the event of liability of Marketing for
Business Success Pty Ltd, liability is limited to the replacement of the
software or the supply of equivalent software or the repair of the software or
the payment of the cost of replacing the software or of acquiring equivalent
software and subject to Section 68A Trade Practices Act 1974. Marketing for
Business Success Pty Ltd may elect any one of the limited forms of compensation
to the exclusion of others set out in Section 68A Trade Practices Act 1974.
The terms of the licence agreement and the respective obligations of the parties
and the extent of their obligations are set out in the Software Licence
Agreement forming part of the product.
